Two vehicle crash

ROCKEFELLER TOWNSHIP - No one was injured in a two-vehicle crash Wednesdsay morning on Route 890 at the intersection with Brush Valley Road.

State police at Stonington report that at 8:33 a.m., a 2007 Toyota Camry, driven by John W. Epler, 89, of Paxinos, was traveling west on Seven Points Road when a 2004 Audi TT, driven by Jill M. Campbell, 28, of Gratz, was traveling north on Route 890.

After stopping at the intersection, Epler attempted to cross the highway to continue onto Brush Valley Road, when the Camry was struck on the driver's side by the oncoming Audi.

Police said Epler will be cited for a traffic violation. Assisting police at the scene were Americus Ambulance, Friendship Hose Company and the Sunbury Fire Department.

Theft charges

RALPHO TOWNSHIP - Brandi Nicole Benjamin, 21, of 119 W. Montgomery St., Shamokin, was charged by Sgt. Chris Kreisher with theft, receiving stolen property and two counts of access device fraud relating to a May 5 incident at Knoebels Amusement Resort.

According to a criminal complaint, Benjamin is accused of stealing a purse from the antique car ride section of the park containing $490 in cash and several credit cards. Police said Benjamin then used the credit cards to purchase $573.50 worth of items at Wal-Mart Supercenter along Route 61 in Coal Township and $43 worth of fuel at the Friendly Choice Market on East Sunbury Street in Shamokin.

The victim of the theft was not identified by police.

Disorderly conduct

SHAMOKIN - Travis Smallwood, 20, of 325 N. Shamokin St., Apt. 3A, Shamokin, was cited by Patrolman Jarrod Scandle for disorderly conduct and harassment relating to a fight at 4:30 p.m. May 24 at Shamokin and Spurzheim streets.

Harassment

NORTH MANHEIM TOWNSHIP - The investigation continues into an altercation between a Lavelle woman and a Pottsville man at 1:40 p.m. Thursday at the Burger King restaurant on Route 183, in this Schuylkill County township.

State police at Schuylkill Haven report two people, Tyrone E. Bruton, 44, of Pottsville, and Abigail M. Zweizig, 28, of Lavelle, were engaged in a verbal argument at the restaurant which then turned physical when Bruton bit Zweizig's middle finger on her right hand and slapped her on the back.

Zweizig then punched Bruton four times in the head with a closed fist. In the midst of the physical altercation, Bruton unlawfully took Zweizig's cell phone and left the scene.

Dog runs at large

SHAMOKIN - Michael Shepherd, 24, of 630 W. Mulberry St., Shamokin, was cited by Patrolman Scott Weaver for allowing his dog to run off his premises onto the property of Joy Kimsal, of 623 W. State St., Shamokin, at 11:55 a.m. May 28.

Charges pending

TREVORTON - Zerbe Township Patrolman Josh Moyer reported Sarah Topolski, 21, of 361 Hickory Ridge Road, Coal Township, will be cited for driving without a license, driving under suspension, limitations on overtaking a vehicle on the left and failure to drive in a single lane relating to a two-vehicle accident Friday afternoon at the intersection of Route 225 and Scott Street.

Police reported Topolski was driving a 2003 Mitsubishi Eclipse north on Route 225 at 1:30 p.m. when she attempted to pass a truck on the left operated by William L. Scott, 44, of 1217 Scott St., Trevorton, who was attempting to make a legal left turn in his 1996 Ford F-150 truck.

Police said Topolski swerved her vehicle after realizing the truck was turning left, causing her car to exit the highway and strike a drainage ditch and pole before re-entering the road, spinning 180 degrees and coming to rest in a baseball field parking lot off Route 225.

The truck was not damaged in the accident.

Assisting police at the scene were Trevorton Fire Chief Ed Reed and other Trevorton firefighters.

Assault

LYKENS - Andrew John Mihalick, 29, of Williamstown, was charged by state police at Lykens with felonies of burglary and aggravated assault relating to a May 26 disturbance at 710 Park View Road.

Police reported Mihalick is accused of attacking Matthew John Shultz, 31, of Lykens, after entering his residence at 3:48 a.m. Police said Mihalick kicked Shultz in the face and punched him in the head and face.

Roving DUI patrol

SELINSGROVE - State police at Selinsgrove will be conducting a DUI checkpoint and roving detail at an undisclosed location between June and July in Snyder County.

PennDOT sign stolen

WASHINGTON TOWNSHIP - State police at Selinsgrove are investigating the theft of a PennDOT road sign indicating a flag man ahead from Hoffer Road near Orchard Hill Road in this Snyder County township.

Police said the sign was stolen between Wednesday and Friday.

Retail theft

MONROE TOWNSHIP - State police at Selinsgrove have charged two people with retail theft in separate incidents that occurred at Wal-Mart along Susquehanna Trail.

Michael Robert Ott, 32, of Williamsport, was charged with stealing a Turtle Beach headset for Xbox valued at $159.96 shortly after 5 p.m. Saturday.

A 16-year-old Mifflinburg female was charged with stealing cosmetic items before being stopped by loss prevention personnel.

Cameron Bridge accident

COAL TOWNSHIP - Two vehicles had to be towed from the scene of a crash late Saturday night on Route 61 at the Cameron Bridge intersection.

Patrolman Jason Adams reported Timothy Wood, 28, of Shamokin, was driving a 2001 Dodge Inteprid south on Route 61 at 10:40 p.m. when he proceeded through a green traffic signal at the Cameron Bridge intersection. Police said a 1989 Honda Prelude driven north on Route 61 by Lawrence Funk, 55, of Trevorton, then made a left turn in front of Wood's vehicle, causing a collision. Police said Funk was attempting to proceed over to Route 225 to travel toward Trevorton.

No injuries were reported.

Police said Funk will be cited for failing to obey traffic control devices.

Child assaulted

SHAMOKIN - John Jay Hackenburg, 32, an inmate at Northumberland County Prison in Sunbury, has been charged by Patrolman Jarrod Scandle with simple assault and endangering the welfare of a child involving an April 28 disturbance at 150 S. Pearl St.

Police reported Hackenburg is accused of striking a boy in the face and stepping on his head, causing several injuries. The incident occurred while Hackenburg was living with the victim's mother.

Hit and run crashes

SUNBURY - State police at Stonington are investigating a rash of hit and run crashes early Monday morning in Rockefeller Township.

Betty Wynn, 81, and Lisa Koons, 39, both of Paxinos, reported to police that sometime between 12:01 and 7 a.m. Monday, an unknown vehicle struck their mailboxes. Around the same time period, someone struck a mailbox owned by Cheryl Zellers, at her residence on Plum Creek Road,

At 7:30 a.m. Monday, someone struck a fence at the home of Eddie Furman on Saint Luke's Road, Rockefeller Township. Police identified the vehicle in that incident as an Oldsmobile sedan driven by a female.

DUI charges

SHAMOKIN - Stormie Birster, 20, of 27 E. Sunbury St. Apt. 3, Shamokin, was charged by Patrolman Raymond Siko II with two counts of driving under the influence of alcohol, driving under the influence of alcohol while being a minor, underage drinking, driving without a license and careless driving relating to a May 29 incident at Independence and Rock streets.

Siko also charged Michael R. Barker, 21, of 29 E. Seventh St., Mount Carmel, who was a passenger in the vehicle driven by Birster, with possession of drug paraphernalia for possessing 10 marijuana seeds in a clear plastic bag.

Fields vandalized

EAST CAMERON TOWNSHIP - Neil Masser, of Leck Kill, reported to state police at Stonington that sometime between 12:01 and 7 a.m. Monday, someone entered his newly planted field off of Upper Road in East Cameron Township and pulled several hundred corn seedlings from the field, damaging approximately $250 worth of plants.

Throws garbage

SHAMOKIN - Corey J. Feese, 22, of 530 Bear Valley Ave., Shamokin, was cited by Patrolman Scott Weaver for violating a city ordinance by throwing two bags of garbage onto his neighbor's property behind 508 Bear Valley Ave. at 10:35 a.m. Friday.

Public drunkenness

SHAMOKIN - John D. Yoder, 60, of 144 S. Pearl St., Shamokin, was cited by Cpl. Darwin Tobias III for public drunkenness after he was found lying in the park plot at Market and Chestnut streets at 6:45 p.m. Friday.

Urinates on porch

SHAMOKIN - Patrolman Scott Weaver cited Douglas Ebright, 49, of 304 S. Pearl St., Shamokin, for violating a city ordinance for being intoxicated and urinating on a neighbor's porch in the 400 block of South Pearl Street at 12:45 p.m. Friday.

2 cited for fighting

SHAMOKIN - Matthew Raynor, 26, of 101 S. Franklin St., Shamokin, and Brian Murdorf, 20, of 241 S. Vine St., Shamokin, were cited by Chief of Police Edward Griffiths for disorderly conduct for fighting at Pearl and Pine streets at 10:23 p.m. Wednesday.

Criminal trespass

MOUNT CARMEL TOWNSHIP - Nicholas C. Elliott, 18, of 1240 Poplar St., Kulpmont, was charged by Patrolman Matthew Filarski with two counts of criminal trespass, loitering and prowling at night and criminal mischief with attempting to break into the residence of Steven Kaminski at 186 Main St., Locust Gap, and damaging a door at about 11:15 p.m. April 13.

Drug charges

SHAMOKIN - Richard C. Ortlip, 49, of 805 E. Sunbury St., Shamokin, was charged by Patrolman Raymond Siko II with possession of three ocycontin and 13 oxycodone pills, possession of drug paraphernalia, possession of a misbranded controlled substance, driving under suspension, driving without proper registration, driving without insurance and driving a vehicle with a cracked taillight and brake light.

The charges were filed in connection with a May 26 incident on Commerce Street near Mount Carmel Street.

Underage drinking

MOUNT CARMEL - Officer Patrick McAndrew cited Justin B. Schriner, 19, of 322 W. Spruce St., Shamokin, for underage drinking relating to an incident at 5:30 a.m. June 3 in the 200 block of South Chestnut Street.

During an investigation, police apprehended Anthony McGinley, 29, of 325 S. Plum St., Mount Carmel, who was wanted on a bench warrant out of Lycoming County. McGinley was incarcerated at Northumberland County Prison in Sunbury.

Disorderly conduct

COAL TOWNSHIP - Nicholas Karlaza, 20, of 21 Back St., Mount Carmel, was charged with disorderly conduct following an incident on West Spruce Street at 3:56 a.m. May 17.

Coal Township Police Patrolman Chris Lapotsky said Karlaza was removed from a residence by Chase Gallie and was standing on the front porch banging on the door to get back inside when he smashed the window on the door.

Harassment

MOUNT CARMEL - Officer David Donkochik cited Barry A. Strike, 61, of 517 E. Fourth St., Mount Carmel, for harassment.

Police said Strike repeatedly harassed a 16-year-old female in the 100 block of East Water Street at 7:25 p.m. June 1.

Disorderly conduct

SHAMOKIN - James Mowery, 22, of 231 S. Vine St., Shamokin, was cited by Shamokin City Police Patrolman William Zalinski for disorderly conduct following an incident at 12:30 a.m. Tuesday in the 600 block of Bear Valley Avenue.

Police say Mowery was in the street, repeatedly threatening another person and yelling obscenties, and failed to stop after police told him to.

Theft charges

MOUNT CARMEL - A 13-year-old male, a 15-year-old male and a 14-year-old male, all from Mount Carmel, were charged by Patrolman William Adamski with theft, receiving stolen property and conspiracy to commit theft relating to an incident at 1:30 a.m. May 6.

Police said the teens are accused of taking a registration plate from a vehicle and stealing another vehicle.

The juveniles were stopped by police while in possession of the stolen vehicle that contained the stolen registration plate.

Retail theft

COAL TOWNSHIP - Dawn Fegley, 51, of 9A E. Commerce St., Shamokin, was charged by Coal Township Police after an incident at the Wal-Mart SuperCenter, at 11:07 a.m. May 30 when she allegedly pushed out a shopping cart with $85.88 worth of merchandise inside it without making a payment.

Ordinance violations

TREVORTON - Zerbe Township Police cited the owners of four properties for violating a township ordinance by failing to cut their grass. Those cited are, Pauline Kolody, of 603 W. Mulberry St., Coal Township; Carol Whary, of Box 439 Trevorton Road, Shamokin; Joshua Seedor, of 132 E. Market St., Trevorton, and Sopramco III REO LLC, Fairport, N.Y.

The property owners were notified and have five days to comply with ordinance.

Two injured

WHITE DEER TOWNSHIP - Two New Columbia men suffered injuries in a one-car crash Wednesday night along New Columbia Road near Gray Hill Road in this Union County township.

State police at Milton reported Zebulun G. Heddings, 19, was driving a 2003 Honda S2000 west on New Columbia Road at 7:10 p.m. when his car exited a left curve in the road at a high rate of speed and traveled into the opposite lane. Police said Heddings over-corrected, causing his vehicle to travel back across the road and strike an embankment. The auto then overturned onto its roof and traveled approximately 140 feet before coming to rest.

Police said Heddings suffered major injuries and was flown by Life Flight helicopter to Geisinger Medical Center in Danville. His passenger, Justin B. Koch, 22, suffered moderate injuries and was taken by ambulance to Geisinger.

Heddings and Koch underwent emergency room treatment and were listed in fair condition Thursday, according to a hospital spokeswoman.

Police reported Heddings was cited for driving too fast for road conditions.

Ordinance violation

COAL TOWNSHIP - Thomas G. Urbanowicz Jr., 30, of 541 S. Market St., Shamokin, will be cited by Deputy Police Chief Chris Williams for violating a township burning ordinance at 9:05 p.m. Saturday by burning pieces of pressure-treated lumber and cardboard off Route 125 on the Burnside Mountain.

Simple assault

COAL TOWNSHIP - Deputy Police Chief Chris Williams charged Joseph C. Thew, 45, of 39 S. Owl St., Shamokin, with simple assault and harassment relating to a disturbance shortly after 8 p.m. Monday at his residence.

Police reported Thew assaulted his girlfriend, Betty Yost, who suffered a head injury that required medical treatment at Geisinger-Shamokin Area Community Hospital.

Thew was committed to Northumberland County Prison in Sunbury on a probation violation.

False reports

COAL TOWNSHIP - Katie Labus, 20, of 400 S. Bay St., Coal Township, will be charged by Deputy Police Chief Chris Williams with making false reports to police in connection with an incident at 12:47 a.m. May 31 in the 900 block of Pine Street.

Police said Labus intentionally misidentified Jordan Myers, who was charged in the same incident, because she knew there was a warrant for Myers' arrest.

Simple assault

ELDRED TOWNSHIP - A Pitman man is in Schuylkill County Prison following a domestic incident at 5:30 p.m. Wednesday at a Ridge Road apartment in Eldred Township.

State police at Schuylkill Haven say John S. Petrovich, 32, of Pitman, became involved in a verbal altercation with a 32-year-old female over Petrovich driving her car. As it escalated, Petrovich pushed, choked and pulled the female to the ground by her hair, pulling a large tuft of it from the back of her head.

Petrovich and the female continued to fight, and he then threw a large wooden chair at her, a 13-year-old female and a four-year-old male. The teenager attempted to shield the four-year-old but the chair struck both of them, The 13-year-old was struck on her right wrist, which caused her to suffer pain and swelling. while the four-year-old was struck on the head, which caused a raised contusion on the forehead. Petrovich then fled the scene, but was apprehended a short time later at a local tavern.

Petrovich was video arraigned before Magisterial District Judge Carol Pankake of Tremont on charges of simple assault, recklessly endangering another person, and harassment. He was committed to Schuylkill County Prison on $15,000 percentage bail.

Vehicle break-ins

TREVORTON - Zerbe Township police are investigating numerous vehicle break-ins that occurred between Thursday evening and 6:15 a.m. Friday. Police say the actors ransacked several vehicles before removing various items and loose change.

Victims and the items stolen were:

- Christy Miller, of 102 W. Shamokin St., A Tomtom GPS unit, Nintendo DSi-XL video game system, Terry Mugler perfume and various lotion/tanning lotion, and $60 of her daughter's birthday money.

- Michelle Brownawell, of 205 W. Shamokin St., unknown make or model GPS unit.

- Robert Allan, of 129 W. Shamokin St., three Sirius satellite radios, power cords and antennas.

- Dusty Stiely, of 638 W. Market St., unknown amount of loose change.

- Philip Class, of 845 W. Shamokin St., loose change, a knife in a leather sheath that contained another two-inch blade knife.

- Melinda Scholl, of 105 W. Shamokin St., nothing taken but the vehicle was ransacked.

Crash

MANDATA - Two people escaped injury when their vehicles collided Thursday afternoon on Route 225 just north of here in Jackson Township.

Katherine R. Carl, 24, of Millersburg, was driving a 2003 Hyundai Sonata north on Route 3012 at 1:25 p.m. and failed to stop at a stop sign at the intersection with Route 225, according to state police at Stonington. Carl's vehicle crashed into a 1989 Ford LTL 9000, a commercial truck, driven south on Route 225 by Celin L. Sitlinger, 68, of Gratz.

Both drivers were wearing seat belts, troopers said.

Carl was cited for a stop sign violation, according to troopers.

Credit cards stolen

WASHINGTON TOWNSHIP - Several items were taken from the unlocked vehicle of Colline Marie Williams, 38, of Dornsife, between the hours of 11 p.m. June 13 and 6 a.m. June 14 at 1242 Cherrytown Road in Washington Township, according to state police at Stonington.

Trooper Daniel J. Wilk reported someone entered the car, took a black hand purse containing two Visa credit cards and other miscellaneous documents, and fled the scene.

Anyone with information is asked to contact state police at 286-5601.

Vehicle thefts

TREVORTON - Zerbe Township police are investigating numerous vehicle break-ins that occurred on June 14 and June 15 in which an unknown number of suspects ransacked several vehicles before removing various items and loose change.

Patrolman Josh Moyer reported the vehicles of Deborah Boyer, 59, and Michael Boyer, 63, both of 224 W. Shamokin St., were ransacked, but nothing was taken.

However, the vehicle of Clayton Bartholomew, 37, 231 W. Market St., was targeted and prescription medication, $23 in cash and an unknown amount of loose change was taken from him, police said.

Police reminded residents to lock both their home and car doors.

Theft

SHAMOKIN - Two Shamokin brothers and two other local residents who allegedly removed electric motors for vehicles from a vacant property at Fourth and Mulberry streets June 7 have been charged by Patrolman Jarrod Scandle with theft-related offenses.

Raymond Villari III, 27, of 343 S. Fifth St., Shamokin; his 25-year-old brother, Robert L. Villari Jr., of 28 Raspberry Hill, Shamokin; Alice Reichwein, 19, of 1141 W. State St., Coal Township, and Harry L. Wheary III, 23, of 814 N. Washington St., Apt. 6, Shamokin, were charged Wednesday with theft and receiving stolen property. The Villari brothers also were charged with burglary, criminal trespass and criminal mischief.

Robert L. Villari Jr., Reichwein and Wheary remain incarcerated at Northumberland County Prison in Sunbury on probation detainers. Raymond Villari III, who was initially jailed on a probation detainer, was released after the detainer was lifted.

All four defendants were charged in connection with the theft of electric motors for vehicles owned by Robert Gilligbauer, of Shamokin, who owns the property at 251 S. Fourth St. where the theft occurred.

Fight charges

SHAMOKIN - Tara Brabitz, 38, of 409 N. Rock St., Apt. 3, Shamokin, and Wanda Ebright, 32, of 104 N. Grant St., Shamokin, were cited by Patrolman Shane Mowery for disorderly conduct for fighting at 4:05 a.m. June 9 in the 200 block of North Rock Street.

PFA violation

SHAMOKIN - Curtis L. Shaffer, 41, of 1552 Trevorton Road, Coal Township, was charged by Patrolman Raymond Siko II with violating a protection from abuse order by sending five text messages to Megan Holohan within minutes of each other on Feb. 5.

Shaffer was arraigned at 3:30 p.m. Thursday by Magisterial District Judge John Gembic III and released on $5,000 bail.

Two-vehicle crash

UPPER AUGUSTA TOWNSHIP - No one was injured in a two-vehicle crash Saturday afternoon on Route 890, just north of the township line between Upper Augusta and Rockefeller townships.

State police at Stonington said a 2001 Chevrolet Metro, driven by Anthony Santos, 23, of Sunbury, was traveling south on Route 890 and attempting to make a left turn into a private lot when he turned into the path of a 1996 Chevrolet Tahoe, driven by Dave Wendt, 51, of Sunbury. Wendt swerved to the right to avoid impact, but the Metro struck the left front corner of the Tahoe. Both vehicles then came to rest in the private lot.

Neither driver was injured, nor was Wendt's passenger, Mackenzie Erb, 8, of Sunbury. Police said Santos will be cited for the crash.

SHAMOKIN - Arthur w. Pennycoff, 56, of 846 N. Fifth St., Shamokin, was cited for harassment by Shamokin City Police Cpl John J, Brown following an incident at 3:26 p.m. June 16 when Pennycoff allegedly called his ex-wife repeatedly despite being told by police to stop.

Public drunkenness

SHAMOKIN - City Police Patrolman Scott Weaver cited Robert Lee Yost, 26, of 136 S. Second St., Shamokin, for public drunkenness after he was found sleeping on the sidewalk twice in the area of the 00 and 100 blocks of South Second Street at 12:30 a.m. Saturday.

Disorderly conduct

SHAMOKIN - Rosemary Davis, 48, of 551A N. Sixth St., Shamokin was cited for disorderly conduct by Shamokin City Police Patrolman Scott Weaver following an incident in the area of the bandstand on Arch Street at 6:20 p.m. June 18.

Police say that Davis allegedly lied to police concerning an incident that took place with her son and attempted to mislead police to his identity once stopped.

Car crash

CENTRALIA - No injuries occurred in a rear-end collision at the intersection of state routes 61 and 42 in this Columbia County village on Monday. A Honda Civic, operated by Rebekah Carpenter, 19, of Annville, struck a Kia Rio, operated by Bill Sierdzinski, 65, of Ashland, while it was stopped at a stop sign in the southbound lane of Route 42. The Kia was driven from the scene. The Honda had to be towed.

Two-vehicle crash

UPPER AUGUSTA TOWNSHIP - No injuries were reported in a two-vehicle crash at 3 p.m. Monday, on Route 61 near Sunbury.

State police at Stonington say a 2003 Volkswagen Jetta, driven by Natasha L. Toccket, 23, of Sunbury, was following a 2001 Chevrolet Silverado, driven by Jeffrey L. Noll, 56, of West Milton, on Route 61. Noll stopped his vehicle for slowed traffic and was struck from behind by the Jetta. No one was injured in the crash, but the Jetta had to be towed from the scene.

Police say Toccket will be cited for the crash.

Rock causes crash

COAL TOWNSHIP - Two vehicles were damaged in an accident caused by a rock in the roadway on Route 54 near the Aqua Pa. water company.

Coal Township Police say a 2002 Chrysler vehicle, driven by Carol Trombley, 57, of 24 S. Vine St., Mount Carmel, was traveling east on Route 54 when it struck a rock that had fallen into the roadway. Trombley's vehicle sustained minor damage and two flat tires.

A second vehicle, a 2006 Hyundai, driven by Alison Houser, 21, of 34 Brown Lane, Ashland, also struck the rock and sustained minor damage and a flat passenger side front tire.

Court upholds Centralia ruling

PHILADELPHIA - A federal court of appeals has affirmed a lower court's decision to deny an injunction that would stop eminent domain proceedings against most of the residents of Centralia who do not want to leave their homes despite the mine fire burning underneath.

In short, the feds agree Centralia residents must move.

In an opinion handed down Tuesday, the U.S. Third Circuit Court of Appeals denied the petition of Bonnie Hynoski, Stephen Hynoski, Christine Hynoski, Tom Hynoski, Harold Mervine, John Koschoff, Helen Hynoski and Walter Hynoski for a preliminary injunction and reconsideration and affirmed the U.S. District Court decision handed down March 11, 2011.

In 1996, the U.S. Supreme Court denied a petition by the same group, who had their properties condemned due to eminent domain proceedings. In their complaints, the residents say the Columbia County Redevelopment Authority (CCRA), the state, Department of Community and Economic Development (DCED) and the Blaschak Coal Corporation have conspired to remove them from the properties so coal, and associated

revenues, underneath the town can be exploited. They also say the underground fire was never a threat.

The group says all the eminent domain proceedings should be stopped because CCRA and the state withdrew their petitions to take one property, the Netchel property.

On March 11, 2011, U.S. District Court Judge Christopher C. Conner denied their injunction, ruling the residents had not demonstrated a likelihood of success of their case on its merits or any risk of irreparable harm. The state has immunity against such suits and the statutes of limitations had expired.

The filing with the U.S. Court of Appeals by the residents contested those rulings and claimed the U.S. District Court abused its discretion by not having a hearing before ruling on the injunction.

In the opinion written by Judge Michael A. Chagares, the three-judge board agreed with the district court's decision that the residents' claims are time-barred because their complaint was not filed until almost four years after the Netchel settlement and the residents did not explain why there was a delay.

"There are no allegations in the (residents') brief, motion or amended complaint that attempts to explain the delay or describe any obstacles that prevented the appellants from discovering the Netchel settlement," the opinion reads. "Moreover, the (residents') do not explain how they eventually learned about the Netchel settlement."

Judges also affirmed the district court's decision the residents did not allege any imminent irreparable harm by losing their properties, denying the injunction.

Because the Centralia residents did not support their claims of harm in their filings, the U.S. District Court ruled they are not obliged to hold a hearing prior to denying the motion for the injunction to the eminent domain proceedings. The U.S. District Court affirmed that decision as well.

One injured

PAXINOS - An Elysburg woman was taken to a hospital for treatment following a two-vehicle crash on Route 61 near Masser's Farm Market at 10:54 a.m. Wednesday.

State police at Stonington report a 2005 Lexus LS430, driven by Jill M. Klinger, 47, of Elysburg, pulled from Masser's Farm Market parking lot into southbound traffic on Route 61. The Lexus was struck on the driver's side by a 1997 Dodge Ram 3500, driven by Jason S. O'Connor, 32, of Northumberland.

Klinger suffered moderate injuries in the crash and was transported to Geisinger Medical Center, Danville, by Elysburg Ambulance. A condition report was not available Tuesday afternoon.

O'Connor and his passengers, a 10-year-old male, 3-year-old male, and a 7-year-old female, were not injured in the crash. Police said Klinger will be cited for the crash.

Attempted burglary

GIRARDVILLE - An 18-year-old Girardville woman is facing charges of attempted burglary for allegedly trying to gain entry into Jiffy Mart Convenience Store at 4:07 p.m. June 26, according to state police at Frackville.

Trooper Paul E. Hardnock said Melinda Marie Mahmod was observed on the roof of the business at 146 N. Second St.

Investigation continues

LOWER MAHANOY TOWNSHIP - State police at Stonington continue to investigate a burglary at 11:50 a.m. Tuesday at a home on Mahantongo Creek Road.

According to police, a person or persons entered a residence owned by K. Souder, 52. of Dalmatia, through a sliding glass door. Police also reported the person or persons first knocked on a locked front door, and when no one answered, knocked on the sliding glass door before entering the home.

No items were reported missing or displaced at the residence and the actor fled undetected, police said.
