MOUNT CARMEL - The following hearings took place Wednesday before Magisterial District Judge Hugh Jones. Defendants ordered to appear for plea court at Northumberland County Courthouse, Sunbury, can plead guilty or no contest, or seek a trial by pleading not guilty.
n Dustin Michael Rogers, 18, of 38 N. Maple St., Apt. 3, Mount Carmel, charges of theft and receiving stolen property were withdrawn when the victim failed to appear for the hearing. Rogers was charged by Mount Carmel Lt. Christopher Buhay for allegedly stealing an MP3 player and headphone set from Robert Rath's daughter Sept. 10 in the 400 block of East Avenue.
n Alexander Keith Clayberger, 40, of 1471 Poplar St., Kulpmont, pleaded guilty to possession of drug paraphernalia and was sentenced to 12 months probation and a $500 fine plus court costs. Charges of possession of a controlled substance, misbranding a controlled substance and public drunkenness were withdrawn. Kulpmont Patrolman Michael Pitcavage filed the charges after Clayberger arrived at the police station Sept. 13, asked to use the bathroom and also asked if an officer wished to speak with him. He was found in possession of a plastic baggie containing white powder and a broken Methadone pill.
n Joseph S. Spagnolo III, 36, and Heather Lynn Mattingly, 34, both of 246 S. Oak St., Apt. 2, Mount Carmel, waived charges of access device fraud, theft, receiving stolen property and three counts of criminal conspiracy. Mount Carmel Patrolman Jason Drumheller filed the charges against Spagnolo and Mattingly, both of whom are accused of using a Discover credit card owned by Robert Ficca to make purchases and cash advances totalling $298.85 in June and July at the borough's Dollar General store.
n Robert A. Broadt, 43, of 302 E. Columbia Ave., Atlas, pleaded guilty to disorderly conduct and was sentenced to pay a $200 fine plus court costs. Charges of possession of marijuana, possession of a small amount (8 grams) of marijuana, possession of drug paraphernalia, simple assault, a second count of disorderly conduct and harassment were withdrawn.
Mount Carmel Township Patrolman Michael Pitcavage filed the charges against Broadt, who was accused of hitting Cindy Berkoski in the head with a telephone, pushing her onto a couch and injuring her hip. She required medical treatment at Geisinger-Shamokin Area Community Hospital, police said.
n David Xavier Hernandez, 19, of 244 W. Cherry St., Mount Carmel, waived counts of corruption of minors and harassment. Mount Carmel Township Patrolman Brian Carnuccio filed the charges against Hernandez, who is accused of having an inappropriate relationship with a 14-year-old female and frequently texting the teen. Carnuccio noted in a criminal complaint that Hernandez had been charged in February with corruption of minors. That count was not prosecuted by the county district attorney after the alleged victim, also a 14-year-old female, refused to testify, according to online court records.
n Scott M. Eveland, 43, of 1341 W. Arch St., Coal Township, waived two counts of driving under the influence, failure to have a vehicle registration card, failure to have vehicle insurance, careless driving and roadways laned for traffic. Trooper Thomas Leib, state police at Stonington, filled the charges related to a traffic stop Sept. 21 after which blood testing found Eveland's alcohol level to be 0.147 percent.
n Samuel Peter Jones, 19, of 206 11th St., Danville, waived a charge of conspiracy, nine counts of receiving stolen property, nine counts of theft from motor vehicle and one count of corruption of minors.
Jones and three others are accused of participating in multiple thefts, including from vehicles, throughout Riverside between Nov. 2 and Nov. 10. Approximately $650 in goods including an iPod Touch, an iPad Nano, an Igloo Marine cooler and cash were stolen from nine victims.
Jones had originally been charged by Riverside Cpl. Kerry Parkes only with stealing the cooler and its contents. Those charges were withdrawn and new charges filed.
Online court records show charges were not filed against two of the alleged co-conspirators. The third is a juvenile male.
